PLEASE READ THESE TERMS  CAREFULLY BEFORE USING OUR PLATFORMS

Terms of Use

These terms of use, together with any documents they expressly incorporate by reference (collectively, “Terms of Use”), govern the services, access to and use of our proprietary technology platforms, including Connect (“Connect”),  Pathways (“Pathways”) and the Accutrainee Connect mobile app (“Connect App”) (together the “Platforms”) provided by Accutrainee Limited (“We,” “Our”, “Us”) to you (“you,” “your”), including any content, functionality, services or products available to you on or through the Platform(s).

Please read these Terms of Use carefully before you start to the Platform(s). By using the Platform(s) or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use, Our Privacy Policy and Our Cookie Policy, all of which are incorporated by reference. If you do not agree to these Terms of Use you must not access or use any of the Platforms.

These Terms of Use should be read together with the Accutrainee Website Terms and Conditions.

Changes to Terms of Use

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when We post them.

Your continued use of the Platform(s) following the posting of revised Terms of Use means that you accept and agree to any changes. Please check this page from time to time so you are aware of any changes, as they are binding on you.

Platform Services

These Terms of Use apply to you as a user of the Platform(s) if you are: (i) a client; (ii) a candidate engaged through our services; or (iii) a third party contracted with us.

From time to time, We may offer additional services, and if this is the case, fees and terms for additional services will be agreed separately.

Connect

Connect is a digital client focussed platform where you can post job openings, review and select candidate profiles from shortlists that are prepared through Our extensive database.

Connect offers you a tailored service to match your job openings with suitable candidates.  It allows us to streamline and accelerate the recruitment process to support you more efficiently.  

Connect App

Connect App is a mobile app available to candidates already accepted onto our successful candidate database. The app gives users quick and convenient access to public live opportunities, the ability to express interest in those opportunities and supports in managing the selection process of roles they have been shortlisted for.

Pathways

Pathways is a candidate platform designed to simplify the process of recording your Qualifying Work Experience (QWE) or Period of Recognised Training (PRT).

Users of Pathways can easily organise and track their work across multiple placements over two years, build a detailed journal, and submit work entries for confirmation by a supervising solicitor.  Pathways also enables users to monitor their progress with real-time updates, all in one centralised location. Pathways streamlines the recording process, making it transparent and manageable.

Your Obligations

You are responsible for making all arrangements necessary for you to have access to the Platform(s); and ensuring that anyone who accesses the Platform(s) through your internet connection is aware of these Terms of Use and complies with them.

You agree to provide accurate and complete information when registering onto any of our Platforms, whether posting job descriptions, videos profiles or engaging candidates or clients.  It is a condition of your use of our Platform(s) that all the information you provide is correct, current and complete. You agree that all information you provide to us whether to register with and use our Platform(s) or otherwise is governed by Our Privacy Policy, and you agree to all actions We take with respect to your information consistent with Our Privacy Policy.

If you create, or are provided with, a username (email), password, or any other piece of information as part of a Platform’s security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to the Platform(s) or portions of it using your username (email), password, or other security information.   If there is functionality available to invite a colleague to use a Platform, you will be held responsible for any action taken via your account and will be held accountable for the validity of anyone that you invite.

You agree to notify us immediately of any unauthorised access to or use of your username (email) or password or any other breach of security. You also agree, where applicable, to ensure that you exit/logoff from the Platform(s) fully at the end of each session or use. You agree to use particular caution when accessing the Platform(s) from a public or shared computer, so that others are not able to view or record your password, other personal information or any personal data stored on the Platform(s).

We have the right to disable any username (email), password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.

You acknowledge and agree to use the software at your own risk. We make no representations, warranties, or guarantees regarding any Platform’s functionality, performance, or suitability for your specific needs. We shall not be held liable for any damages, losses, or issues arising from your use of the Platform(s), including but not limited to data loss, system failures, or interruptions in service.  You assume full responsibility for any risks associated with the use of the Platform(s).

Prohibited Uses

You agree to use the Platform(s) solely for legitimate recruitment purposes and will not engage in activities that could harm Our reputation, security or any other user and in accordance with these Terms of Use.

You agree not to use the Platform(s) in any way that violates any applicable laws and regulations, including any employment, anti-discrimination and privacy laws, or to send, knowingly receive, upload, download, use, or re-use any material that does not comply with Our Privacy Policy.

You agree not to:

  • use any Platform in any manner that could disable, overburden, damage, or impair that Platform or interfere with any other party’s use of that Platform;
  • use any automatic device, process, or means to access the Platforms for any purpose, including monitoring or copying any of the material on the Platform(s);
  • use any manual process to monitor or copy any of the material on the Platform(s) for any other purpose not expressly authorised in these Terms of Use, without Our prior written consent;
  • use any device, software, or routine that interferes with the proper working of any of the Platforms;
  • introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
  • attempt to gain unauthorised access to, interfere with, damage, or disrupt any parts of any of the Platforms or any server, computer, or database connected to any of the Platforms; or
  • otherwise attempt to interfere with the proper working of the Platform(s).

Whilst working with us or through your use of the Platform(s), you may gain access to confidential information about Our clients, candidates, or third parties. You agree that:

  • you may also share this information with Our head office employees only, without exception, and this includes not sharing this information with any other recruitment companies or other third parties; and
  • this sharing of information is only permitted through the functionality available on the Platform(s);
  • you will not reproduce or publicly display or disclose any profile information about Our Candidates; and
  • you will not use the Platform(s) or any of the products or services provided by Us to develop competitive products or services.

 

Data and Privacy

In addition to the obligations set out in Our Privacy Policy, you agree to maintain the confidentiality of client and candidate information obtained through the Platform(s) and not to share this information with any third party, without Our explicit written consent.

When you receive client or candidate information you agree to respect the security of the personal data and to treat it in accordance with the law.  You will not use the personal data for your own purposes and only permit the data to be processed for specified purposes and in accordance with Our instructions.

You agree to handle personal data in compliance with all applicable data protection regulations.

All information We collect under these Terms of Use are subject to Our Privacy Policy. By using the Platform(s), you consent to all actions taken by us with respect to your information in compliance with Our Privacy Policy. 

Interview Process

All interviews will be conducted virtually unless otherwise agreed between the candidate and client.

Any changes to the dates or time of the interview must be communicated promptly by one party to the other.

The meeting link and access information are confidential and should not be shared with unauthorised parties.

If interviews are conducted in person, they should take place at a mutually agreed upon location that is professional, safe, and conducive to confidentiality. The location should be reasonably accessible to all parties involved, taking into account travel time and accommodations where applicable. The party hosting the interview will ensure that the venue complies with any relevant legal, health and safety standards.

Offer of a Role

Following an interview, and confirmation of offering a candidate a role on the Platform(s) or otherwise, the terms of that candidate’s engagement will be agreed under separate agreements with both the client and candidate.

Platform Availability

Our Platform(s) are made available free of charge.

We will provide the Platform(s) for use on an “as is” and “as available” basis, and while efforts will be made to ensure its functionality, We cannot guarantee or warrant that the Platforms will be available, error-free, or uninterrupted at all times. We are not liable or responsible for any interruptions, delays, or technical issues that may occur during the use of the software, including, but not limited to, system outages, maintenance periods, or any unforeseen circumstances that may affect service availability.

Intellectual Property

We retain all rights, title, and interest in and to the Platform(s), including all improvements or modifications.

Subject to your compliance with these Terms of Use We grant you a limited, non-exclusive, non-transferable license to use the Platform(s).

Limitations of Liability

We do not guarantee the quality, qualifications or suitability of candidates or clients on the Platform(s).

To the fullest extent permitted by law We shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform(s).

Unless otherwise explicitly stated, We are the owner of all intellectual property rights in the Platform(s) and in the material published, including but not limited to any concepts, ideas, methods, procedures, processes, know-how, techniques, programs, publications, models, products, templates, technologies, software designs, logos, artwork, graphics and information on or described in the Platform(s).  All such rights are reserved.

You shall not modify, reproduce, reverse engineer, decompile, disassemble, publicly display, distribute, or otherwise use any content, materials, or intellectual property provided through the Platform(s) without the express, prior written consent of the relevant content or material provider, including any third-party links, services, or resources. Any unauthorised use, reproduction, or distribution of such content or materials is strictly prohibited and may result in legal action.

Termination

We reserve the right to suspend or terminate your access to the Platform(s) if you violate these Terms of Use.

Entire Agreement and Conflict with other Agreements

These Terms of Use, together with our Privacy Policy, Cookies Policy, and any other policies referenced herein, govern your use of the Platform(s). They do not replace or supersede any separate written agreement you may enter into with Accutrainee Limited for the provision of services.

If you have entered into a separate agreement with us for specific services, that agreement will govern those services. In the event of any conflict between these Terms of Use and the terms of a separate written agreement, the terms of that separate agreement will prevail with respect to the services covered by it.

Governing Law and Dispute Resolution

These Terms of Use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We and You agree to the exclusive jurisdiction of the courts of England and Wales.
